Acceptance of Terms
By creating an account or using OpenKnocks, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform. We may update these terms from time to time, and continued use of the platform constitutes acceptance of any changes.
Description of Service
OpenKnocks is a private matching platform that connects homeowners who may be open to selling with buyers who are actively searching for a home. The platform facilitates matching, introductions, and structured conversations between users.
OpenKnocks' platform matching services are separate from licensed real estate brokerage services. If users choose to proceed with broker-facilitated services offered through the platform, those services are provided by Stokely Marcus, California DRE License #01874337, subject to any required brokerage agreements and disclosures. Users may also choose to engage their own licensed real estate professionals where permitted.
Creating a profile, reviewing matches, or communicating with another user through the matching platform does not by itself create a brokerage relationship.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when registering and to keep your profile information up to date. Accounts may not be shared or transferred to another person.
User Conduct
You agree to use OpenKnocks only for lawful purposes and in a manner consistent with its intended use as a real estate matching platform. You may not post false, misleading, or fraudulent information, or use the platform to harass, impersonate, or harm other users. OpenKnocks reserves the right to suspend or terminate accounts that violate these conduct standards.
Privacy
Your use of OpenKnocks is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, retain, and disclose information, including our use of cookies, Google Analytics, Microsoft Clarity, and other technologies used to understand and improve the platform. Please review the Privacy Policy for details.
Intellectual Property
All content, design, and technology on OpenKnocks is owned by or licensed to OpenKnocks and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without express written permission. User-generated content remains the property of the user, but you grant OpenKnocks a limited license to display it on the platform.
Disclaimer
OpenKnocks provides the platform on an 'as is' and 'as available' basis without warranties of any kind, express or implied. Estimated market value ranges shown on the platform are automated estimates based on publicly available data and are not appraisals, broker opinions, or offers to buy or sell. OpenKnocks is not responsible for the accuracy of user-submitted information.
Limitation of Liability
To the fullest extent permitted by law, OpenKnocks shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform. OpenKnocks is not a party to any real estate transaction facilitated through the platform and assumes no liability for the outcome of any such transaction. Our total liability to you for any claim shall not exceed the amount you paid to use the platform in the twelve months preceding the claim.
Termination
OpenKnocks may suspend or terminate your access to the platform at any time and for any reason, including violation of these terms. You may also delete your account at any time through the Account Settings page. Upon termination, your profile and associated data will be removed in accordance with our Privacy Policy.
Governing Law
These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of those courts.
